1Scope

(1) These Terms and Conditions apply to all orders placed by consumers and businesses via the holzkistenhaus.de online shop.

(2) The contracting party is the operator of the Holzkistenhaus online shop (hereinafter referred to as "we"). Full provider details can be found in the legal notice and in § 14 of these Terms and Conditions.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).

2Conclusion of Contract

(1) The presentation of products in the shop does not constitute a legally binding offer, but an invitation to place an order.

(2) You can add products to your basket and enter your details during checkout. Before submitting, you can review and amend all information. By clicking the 'Order with obligation to pay' button, you submit a binding offer to purchase the goods in your basket.

(3) We will confirm receipt of your order immediately by e-mail. This confirmation of receipt does not yet constitute acceptance. The contract is concluded when we accept the order by e-mail or dispatch the goods. In the case of advance payment, the contract is already concluded with the e-mail in which we confirm execution of the order or request payment (order confirmation). If you do not receive an order or dispatch confirmation within 2 days, you are no longer bound by your order; any payments already made will be refunded immediately.

(4) Order processing and the transmission of all information required in connection with the conclusion of the contract are carried out by e-mail, in some cases automatically. Please ensure that your e-mail address is correct and that receipt is not prevented by SPAM filters.

(5) The contract language is German. We store the contract text; you will receive the order data and these Terms and Conditions by e-mail.

3Prices and Shipping Costs

(1) All prices are final prices in euros and include statutory VAT. Shipping costs may apply and are shown in the shop with the products and under Shipping & Payment are specified and will be shown before you complete your order.

(2) For deliveries to countries outside the EU, additional customs duties, taxes or fees may apply.

4Payment

(1) The available payment methods are shown during the order process and under Shipping & Payment described.

(2) For bank transfer (prepayment), the invoice amount must be paid within 7 days of concluding the contract to the specified account. We will dispatch the goods once payment is received.

5Delivery

(1) Orders are processed and dispatched within 24 hours on working days (in the case of advance payment, after receipt of payment). The delivery time is – unless otherwise stated for the product – 2–3 working days from dispatch.

(2) If a product you ordered is unavailable, we will inform you immediately and refund any payments already made.

(3) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods during shipment passes to you only upon delivery of the goods, regardless of whether the shipment is insured or uninsured.

6Retention of Title, Right of Retention

(1) The goods remain our property until full payment has been received.

(2) You may only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.

7Cancellation policy

Consumers have a statutory right of cancellation. Details can be found in our Cancellation policy. In addition, we grant a voluntary 30-day return policy (§ 8).

8Voluntary 30-day Return Policy

(1) In addition to the statutory right of withdrawal, we grant you a voluntary return policy of a total of 30 days from receipt of the goods. Within these 30 days, you may return goods that are unused and in perfect, original condition without giving any reason.

(2) Please notify us of your return by e-mail to kontakt@holzkistenhaus.de or via our returns form ; we will provide you with the return address or a return label. You bear the direct costs of returning the goods. We will refund the purchase price after receipt and inspection of the goods.

(3) Personalised or custom-made goods are excluded.

(4) The voluntary return policy does not affect your statutory right of withdrawal (§ 7) or your statutory warranty rights (§ 9).

9Warranty

(1) Statutory warranty rights apply.

(2) Our crates are handmade from solid wood. Natural features such as grain, knots, minor colour variations or slight differences in the burnt-effect finish are typical of the material and do not constitute a defect.

(3) Please report any obvious transport damage to the courier immediately if possible and inform us. Your statutory rights remain unaffected.

(4) Insofar as a characteristic of the goods deviates from the objective requirements, the deviation shall only be deemed agreed if you were informed of this before submitting your contractual declaration and the deviation was expressly and separately agreed.

10Liability

(1) We are fully liable for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.

(2) In the event of slightly negligent breach of essential contractual obligations, liability is limited to typical, foreseeable damages. Otherwise, liability for slight negligence is excluded.

11Vouchers and Promotions

Gift vouchers and promo codes can only be redeemed at holzkistenhaus.de. Discounts cannot be combined unless otherwise stated. Cash payout is not possible.

12Applicable Law

(1) German law applies. For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence (principle of favourability).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

13Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
